Judicial Review Act 1991

  • AB v Independent Broad-based Anti-corruption Commission [2024] HCA 10: Statutory natural justice provisions will be interpreted in the light of - or against the background of common law natural justice obligations. See [1.1470].
  • Patrick v Australian Information Commissioner [2024] FCAFC 93: The applicant sought to appeal against the dismissal of his judicial review application made pursuant to s 7(1) of the ADJR Act. See [1.1740].
  • Ismail v Minister for Immigration, Citizenship & Multicultural Affairs [2024] HCA 2: A failure to inquire may lead to a decision which is capable of being set aside for ‘legal unreasonableness’ but this is generally rare. See [1.1850].
