The Checklist, Application of the unfair contract terms regime and assessing whether a term is unfair is designed to assist businesses to determine whether a contract is subject to the unfair contract terms regime under the Australian Consumer Law (ACL) and assess whether the terms of the contract may be unfair. It also provides a checklist of considerations to assist businesses to implement a general contract risk management strategy to reduce the risk of contravening the unfair contract terms regime.
