This Subtitle expounds the provisions of Ch 6 of the Corporations Act 2001 (Cth) which regulate the acquisition of shares that may have an effect on the control of a company. This update discusses bid class securities and escrow agreements, as well as the rights of holders of convertible securities. ASIC Regulatory Guide 9 “Takeover Bids” is referenced throughout.
