The Lawyers Practice Manual (Vic) has recently published updated Chapter 1.8 Acting for an accused in committal proceedings.

Authors Lily Yan and Christjan Corias, Lawyers with the Summary Crime Team, Victoria Legal Aid; and Christina Cussen, Acting Managing Lawyer, Indictable Crime Victoria Legal Aid have updated the chapter to include a range of changes including:

  • what must be included in the application for leave for cross-examination of witnesses at a committal hearing, including whether the informant consents to or opposes leave being granted in respect of that issue, see [1.8.409]
  • what the court must also consider if a witness is under 18 years of age, before granting leave to the accused to cross-examine, including the need to minimise the trauma that might be experienced by the witness in giving evidence, see [1.8.410].
