Practical Law Dispute Resolution has released the following new resources providing comprehensive guidance on evidence principles, practice and procedure in New South Wales and Queensland:
Queensland
- Practice note, Queensland: Evidence (overview), a comprehensive guide to preparing evidence in civil proceedings in Queensland, addressing the admissibility, creation and giving of evidence at common law and under the Evidence Act 1977 (Qld), Uniform Civil Procedure Rule 1999 (Qld) and protocols of practice. It provides best practice guidance for preparing lay evidence, expert evidence and documentary evidence in admissible form.
- Standard document, Queensland: Letter of instruction to expert, an example letter of instruction to an expert witness for use in proceedings in the Supreme Court of Queensland (with integrated drafting notes), prepared in accordance with the requirements in Part 5 of Chapter 11 of the Uniform Civil Procedure Rules 1999 (Qld).
- Standard document, Queensland: Objections to written evidence, an example set of objections to written evidence for use in court proceedings in Queensland (with integrated drafting notes), including examples of the types of objections to written evidence most commonly made and the form in which they may be made.

New South Wales

It provides best practice guidance for preparing lay evidence, expert evidence and documentary evidence in admissible form.
