New Practical Law Dispute Resolution resources on evidence

Practical Law Dispute Resolution has released the following new resources providing comprehensive guidance on evidence principles, practice and procedure in New South Wales and Queensland:

Queensland

  • Practice note, Queensland: Evidence (overview), a comprehensive guide to preparing evidence in civil proceedings in Queensland, addressing the admissibility, creation and giving of evidence at common law and under the Evidence Act 1977 (Qld), Uniform Civil Procedure Rule 1999 (Qld) and protocols of practice.  It provides best practice guidance for preparing lay evidence, expert evidence and documentary evidence in admissible form.
  • Standard document, Queensland: Letter of instruction to expert, an example letter of instruction to an expert witness for use in proceedings in the Supreme Court of Queensland (with integrated drafting notes), prepared in accordance with the requirements in Part 5 of Chapter 11 of the Uniform Civil Procedure Rules 1999 (Qld).
  • Standard document, Queensland: Objections to written evidence, an example set of objections to written evidence for use in court proceedings in Queensland (with integrated drafting notes), including examples of the types of objections to written evidence most commonly made and the form in which they may be made.
  • Standard document, Queensland: Objections to expert evidence, a set of example objections to expert evidence for use in court proceedings in Queensland (with integrated drafting notes), including examples of the types of objections to expert evidence most commonly made and the form in which they may be made.
  • Standard document, Queensland: Trial bundle index, a template trial bundle index (with integrated drafting notes) for use in preparing for a trial, or final or interlocutory hearing in civil proceedings in Queensland.  This resource also identifies related resources to assist in preparing for a trial or hearing (including with respect to the preparation of lay and expert witness evidence).

New South Wales

  • Practice note, New South Wales: Evidence (overview), a comprehensive guide to preparing evidence in civil proceedings in New South Wales, addressing the admissibility, creation and giving of evidence under the Evidence Act 1995 (NSW) and rules of practice and procedure.  It provides best practice guidance for preparing lay evidence, expert evidence and documentary evidence in admissible form.
  • Standard document, New South Wales: Letter of instruction to expert, an example letter of instruction to an expert witness in proceedings in the Supreme Court of New South Wales (with integrated drafting notes) prepared in accordance with the requirements in Part 31, Division 2 of the Uniform Civil Procedure Rules 2005 (NSW) (UCPR (NSW)) and the Expert Code of Conduct in Schedule 7 to the UCPR (NSW).
