Criminal Sentencing 12.3 “Interpretation of Penalty Provisions”

The focus of this Subtitle is the principles of statutory interpretation of penalty provisions and their application. The general principle of interpretation of penalty provisions is discussed, as well as the problems of interpretation posed by repeal or amendment of a penalty provision and by judicial decisions exposing the invalidity of a penalty provision.

Criminal Sentencing 12.6 “Financial Orders: Fines”

This Subtitle deals with the use of fines as a sentencing option for adult offenders in all Australian jurisdictions. This update discusses granting parties extensions to pay fines in South Australia, and the reforms in Western Australia in relation to the way in which fines are enforced and recovered. The new laws also address the disadvantage experienced by Aboriginal and Torres Strait Islander people within the fines and enforcement system.

Environment and Natural Resources 14.5 “Environmental Impact Assessment”

This Subtitle discusses the circumstances in which it is necessary to consider whether a formal environmental impact assessment is required. This update outlines the environmental impact assessment of activities that are likely to significantly affect the environment, as addressed in Palm Beach Protection Group Inc v Northern Beaches Council [2020] NSWLEC 156. The Northern Territory Environment Protection Authority and the reviewing of environmental aspects of proposals are also discussed.
