New Practical Law Dispute Resolution resources on evidence in Victoria

Practical Law Dispute Resolution has released the following new resources providing comprehensive guidance on evidence principles, practice and procedure in Victoria:

  • Practice note, Victoria: Evidence (overview), a comprehensive overview of evidence in civil proceedings in Victoria, addressing the admissibility, creation and giving of evidence under the Evidence Act 2008 (Vic) and rules of practice and procedure. It provides best practice guidance for preparing lay evidence, expert evidence and documentary evidence in admissible form.
  • Standard document, Victoria: letter of instruction to expert, an example letter of instruction to an expert witness for use in proceedings in the Supreme Court of Victoria (with integrated drafting notes), prepared in accordance with the requirements in Order 44 of the Supreme Court (General Civil Procedure) Rules 2015 (Vic) and the Expert witness code of conduct in Form 44A to the Supreme Court (General Civil Procedure) Rules 2015 (Vic).
  • Standard document, Victoria: Objections to expert evidence, a set of example objections to expert evidence for use in court proceedings in Victoria (with integrated drafting notes), including examples of the types of objections to expert evidence most commonly made and the form in which they may be made.
  • Standard document, Victoria: Objections to written evidence, an example set of objections to written evidence for use in court proceedings in Victoria (with integrated drafting notes), including examples of the types of objections to written evidence most commonly made and the form in which they may be made.
  • Standard document, Victoria: Court book index, a template court book index (with integrated drafting notes) for use in preparing for a trial, or final or interlocutory hearing in civil proceedings in Victoria. This resource also identifies related resources to assist in preparing for a trial or hearing (including with respect to the preparation of lay and expert witness evidence).
