Practical Law have released an article that considers the Spam Regulations 2021 (Cth), which provide greater clarity as to what is required to unsubscribe from commercial electronic messages and exclude faxes from the definition of commercial electronic message.

The Article, Are your electronic business marketing communications compliant with the Spam Regulations 2021 (Cth)? considers the Spam Regulations 2021 (Cth) (SR 2021), which applied from 1 April 2021. The SR 2021 exclude faxes from the definition of "commercial electronic message" and clarify how to provide the unsubscribe facility and the extent to which personal information can be solicited by companies as part of the unsubscribe process. Recipients of the commercial electronic message must be able to unsubscribe without providing personal information or by logging in to or creating an account with the sender.
