Practical Law Commercial have released a brand new resource, Legal Update, Social Media (Basic Expectations and Defamation) Bill 2021 (Cth) to make social media service providers liable for defamatory content posted on their platforms. This legal Update considers the Social Media (Basic Expectations and Defamation) Bill 2021 (Cth) (Social Media Bill 2021), which was introduced to Parliament on 25 October 2021.

The Social Media Bill 2021 was introduced to Parliament to provide greater protection for social media users by enabling the Minister to set basic expectations of a social media service provider in relation to defamatory material posted on their platforms, and to hold social media service providers accountable for defamatory material posted on their platforms that is not removed in the required timeframe. Social media service providers and the end-user who posted the defamatory material may be jointly liable for defamatory material posted on the social media platform.
