Legal update: archive, New Therapeutic Goods Advertising Code commences 1 January 2022 discusses the key changes provided by the new Therapeutic Goods (Therapeutic Goods Advertising Code) Instrument 2021 (Therapeutic Goods Advertising Code) which repeals the Therapeutic Goods Advertising Code (No. 2) 2018 and will commence on 1 January 2022.

Advertisers will have until 30 June 2022 to transition from the current Therapeutic Goods Advertising Code (No. 2) 2018 to the new Therapeutic Goods Advertising Code. During this six-month transition period, advertisers may apply either the current Therapeutic Goods Advertising Code (No. 2) 2018 or the new Therapeutic Goods Advertising Code.

The Therapeutic Goods Advertising Code aims to provide a clearer and easier application of advertising rules, while still meeting the requirements of the Therapeutic Goods Act 1989 (Cth). The TGA aims to publish updated guidance materials and host webinars to assist advertisers with complying with the new Therapeutic Goods Advertising Code.
