The new Commercial Contract Clauses: Principles and Interpretation (4th Edition) is essential reading for all solicitors, barristers and legal professionals involved with contract law issues in commercial contracts. Since the third hardback edition of this work, Commercial Contract Clauses: Principles and Interpretation has been cited with approval by the High Court, New South Wales Court of Appeal, Queensland Supreme Court and the Western Australia Supreme Court. That confirms its place as a book by practitioners for practitioners.
This new edition of the book includes discussion of recent High Court, Court of Appeal and other intermediate court decisions, decided since the last hardback edition in 2019. It includes exploration of two recent appeal judgments, Tesseract International Pty Ltd v Pascale Construction Pty Ltd [2024] HCA 24 in the High Court in the chapter on joint, several and proportionate liability, and Michael Hill Jeweller (Australia) Pty Ltd v Gispac Pty Ltd [2024] NSWCA 211 in the New South Wales Court of Appeal in the chapter on take or pay clauses.
The authors of this work are the Hon Kenneth Martin KC, formerly one of the most experienced commercial judges of the Supreme Court of Western Australia; Joshua Thomson SC, a former Solicitor-General of Western Australia, as well as having had a wide commercial practice; and Leigh Warnick SC, formerly a senior partner in leading commercial law firms, before going to the Bar. Each of them practises at Francis Burt Chambers in Perth.
Commercial Contract Clauses: Principles and Interpretation (4th Edition) was launched on 19 November 2024 at New Chambers in Sydney by two of the three authors, Joshua Thomson SC and The Hon Kenneth Martin KC. The event was attended by over 40 barristers and judges.
