On 26 February 2025, the Chief Justice reissued Practice Note SC EQ 03 –Commercial List and Technology and Construction List, with a commencement date of 3 March 2025.
The revised Practice Note makes the following changes:
The addition of paragraphs 27 to 29: sets out the required practice should a motion settle. Makes clear that a motion is required where leave is sought to use generative artificial intelligence to prepare or generate an annexure or exhibit to an affidavit or witness statement, or when it sought to be used in experts reports.
The addition of paragraphs 67 and 68: sets out what is appropriate communication with the Court.
Re-number the paragraphs to take into consideration the insertion of new paragraphs 27 to 29.
Updating paragraphs 13 to 15 in the ‘Usual Order for Hearing’ in Annexure 3 to clarify the format and types of documents that are required to be filed with the Court.
