Linking enhancement added to Environmental Responsibilities Law NSW

The Environmental Responsibilities Law New South Wales service provides wide coverage of the environmental legislation administered by the NSW Department of Environment, Climate Change and Water.

Cross-references referring to penalty units in Thomson Reuters’ comprehensive environmental service have recently been enhanced for our online subscribers.

These useful cross-references now state the current value of a penalty unit and link directly to s 17 of the Crimes (Sentencing Procedure) Act 1999 (NSW), which states:

“Unless the contrary intention appears, a reference in any Act or statutory rule to a number (whether fractional or whole) is taken to be a reference to an amount of money equal to the amount obtained by multiplying $110 by that number of penalty units.”

Example: Environmentally Hazardous Chemicals Act 1985 (NSW), s 43

43 Power to require information

... (2) A person shall not, without reasonable excuse, neglect or refuse to comply with any requirement made under subsection (1).
Maximum penalty: 50 penalty units.

[Cross Reference: A penalty unit is $110. See s 17 of the Crimes (Sentencing Procedure) Act 1999.]

Similar cross-reference enhancements are expected to be integrated into a range of Thomson Reuters online publications in the coming weeks. The linking added to cross-references facilitates comprehensive and quick legal research by enabling subscribers to gain access to related legislation simply by a click of their mouse.
