Given the recent decision in the federal court of Australia which found the environment minister, Sussan Ley has a duty of care to protect young people from the climate crisis the latest issue of the Environmental and Planning Law Journal (EPLJ Vol 38 Part 2) is timely. Stefan Prelevic's "Child Rights and Climate Change: Litigative Avenues for Australian Children" focuses on children receiving international recognition for the disproportionate harms they are suffering due to climate change and the implications this has on the realisation of their fundamental human and specific child rights. In the lead up and aftermath of the climate school strikes, the number of child litigants utilising human rights-based arguments in climate change litigation exploded globally.
